Can A Cop Arrest You In The State Of Texas For Refusing To Consent To A Car Search?

The ACLU says they can not without a warrent, but everyone I talk to here says the can detain you for 24 hours. I differentiate about the proable cause and all. Also no I do not carry drugs or weapons in my car, but do not want a cop going though my attitude.

Also I seen a show on courtTV now truTV where a cop arrested a guy for refusing to search of his car.


Often we can nab someone for relatively minor traffic violations (think-having an expired security card or not having your DL with you, etc). Sometimes if someone consents to a search we will let them off the minor violation or just issue a citation. If they rebuff the search, then we have a valid reason to arrest them, which gets us inside the car anyway.

Often its much more complicated that just getting arrested for refusing a search.

How Can I Do A Car Search Feature Like Autotrader?

Autotrader's car search is excellent. When you distinguish a make you get the models available for that make only. I wna do this using php or javascript. How can I do this?

How Do I Find Cases That Involve An Illegal Search & Seizure While The Person Was In A Parked Car? ?

I require to find cases that involve a person being in a parked car and being unreasonably searched ("pat down" and car search). The dick conducting the search found an ounce of marijuana and arrested the person. The defendant is claiming that he was racially targeted and that his 4th Pay right was violated. Does anyone have any case names that are similar/ I tried searching FindLaw.com, but came up with nothing. Offer you for any help you can give me.


Dispute law normally addresses a certain issue about an arrest, not the entire event. Because of this, your search is too catholic. You need to provide more details.
